3.2 The customer is given the opportunity to read these general terms and conditions before concluding the agreement.
3.3 When booking online, the general terms and conditions are made available electronically in a way in which the customer can consult and save them.
3.4 Deviations from these conditions are only valid if they have been expressly agreed between CUPMOVE and the customer.
3.5 If one or more provisions of these conditions prove to be void, voidable or otherwise unenforceable, the other provisions will continue to apply.
3.6 Mandatory legal rights of consumers are not limited by these general terms and conditions.
Article 4 - Conclusion of the agreement
4.1 An agreement is concluded as soon as a booking or purchase has been confirmed by CUPMOVE or the booking system used by CUPMOVE.
4.2 If a deposit is required for an appointment, CUPMOVE may determine that the appointment is only final after this deposit has been received.
4.3 The customer is responsible for providing correct and current information.
4.4 Before finalizing a booking, the customer will receive information about the chosen treatment, the price, the duration and the most important applicable booking conditions.
4.5 CUPMOVE may refuse a booking if there are reasonable grounds for doing so, for example if a treatment cannot be carried out safely or responsibly.
Article 5 - Treatments exclusively for women
5.1 CUPMOVE's regular body treatments are exclusively intended for women.
5.2 The customer will be informed of this before booking.
5.3 CUPMOVE may refuse a booking if it does not fall within this concept.
5.4 If CUPMOVE cancels an appointment that has already been paid for this reason before the treatment has taken place, the amount paid for the treatment not carried out will be refunded.
Article 6 - Nature of the treatment
6.1 CUPMOVE offers cupping and bodywork treatments.
6.2 Cupping uses a vacuum to lift the skin and the superficial underlying tissue. Depending on the treatment, cups can be placed statically or moved over the skin.
6.3 Temporary changes in local blood flow may occur during and after treatment. For example, the treated area may feel and look warmer or pinker.
6.4 Customers may experience a difference after a treatment in, among other things, the feeling of tension, stiffness or comfort of movement. The experience and results differ per person.
6.5 CUPMOVE does not provide medical care and does not make medical diagnoses.
6.6 Treatment at CUPMOVE does not replace examination, diagnosis, treatment or individual medical advice from a doctor or other qualified healthcare professional.
6.7 CUPMOVE does not guarantee any specific physical, cosmetic or therapeutic result.
Article 7 - Intake and health information
7.1 Prior to a treatment, the customer may be asked to complete an intake form.
7.2 The customer must provide information that may be relevant for the safe execution of the treatment completely and truthfully.
7.3 This may relate to, among other things:
- a. pregnancy;
- b. medication use;
- c. use of blood thinners;
- d. skin problems, skin infections or open wounds;
- e. allergies or sensitivities;
- f. thrombosis or relevant vascular problems;
- g. cardiovascular problems;
- h. recent surgeries or medical procedures;
- i. relevant medical treatments;
- j. relevant oncological history;
- k. serious or unexplained physical complaints;
- l. other circumstances that may be relevant to the safety of the treatment.
7.4 If relevant health information changes, the customer must inform CUPMOVE of this before subsequent treatment.
7.5 CUPMOVE may adjust, postpone or refuse treatment if the information provided gives reason to doubt the safety or suitability of the treatment.
Article 8 - Contraindications and safety
8.1 CUPMOVE may decide not to carry out treatment in whole or in part if treatment is not considered responsible.
8.2 Among other things, active skin infections, open wounds or other areas where treatment cannot be safely performed are not treated.
8.3 In case of certain conditions, medication, pregnancy, recent medical procedures or other relevant circumstances, CUPMOVE may advise you to consult a doctor or other qualified healthcare professional in advance.
8.4 If insufficient relevant information is available to carry out treatment responsibly, CUPMOVE may postpone or refuse the treatment.
Article 9 - Implementation of the treatment
9.1 CUPMOVE carries out treatments carefully and to the best of its ability.
9.2 The technique and intensity used can be adjusted to, among other things, the treatment area, the skin, the sensitivity and the customer's reaction.
9.3 During the treatment, the customer must immediately indicate when something feels too intense, unpleasant or painful or when unexpected complaints arise.
9.4 CUPMOVE can adjust the technique, intensity or treatment area during the treatment if this is desirable for careful and safe implementation.
9.5 CUPMOVE is not obliged to use a technique or intensity that it considers irresponsible.
Article 10 - Possible reactions
10.1 Temporary reactions may occur during or after a cupping treatment.
10.2 Possible responses include:
- a. redness;
- b. heat;
- c. temporary sensitivity;
- d. temporary discolorations or cupping marks;
- e. mild itching or tingling;
- f. temporary soreness;
- g. tiredness or feeling relaxed.
10.3 The nature, intensity and duration of these reactions vary from person to person.
10.4 Strong or dark cupping marks are not a goal or requirement of treatment.
10.5 In case of serious, unexpected or persistent complaints, the customer must seek appropriate medical attention.
Article 11 - Preparation and aftercare
11.1 CUPMOVE can provide information or instructions about preparation and aftercare before and after a treatment.
11.2 The customer is advised to follow these instructions carefully.
11.3 This information may relate to clothing, skin care, physical strain and other practical points of attention surrounding the treatment.
11.4 If the customer has any doubts about a reaction after the treatment, she can contact CUPMOVE. In case of serious or medical complaints, appropriate medical assistance should be sought.
Article 12 - Prices
12.1 The price that is shown to the customer before finalizing the booking applies to the treatment.
12.2 Prices shown to consumers include VAT, unless explicitly stated otherwise.
12.3 CUPMOVE may change its prices for future bookings.
12.4 A price change does not affect an already confirmed appointment for which the price has already been agreed.
12.5 Obvious price, writing or input errors do not bind CUPMOVE if it could reasonably be clear to the customer that there was an error.
Article 13 - Down payment
13.1 CUPMOVE may require a deposit of 30% of the total treatment price to book a treatment.
13.2 If a down payment is required, this will be communicated to the customer before finalizing the booking.
13.3 The deposit will be deducted from the total price of the treatment.
13.4 The remaining amount will be paid according to the payment method and the payment time indicated when booking.
13.5 In the event of a timely relocation in accordance with Article 15, the deposit remains linked to the appointment.
13.6 In the event of a no-show, the provisions of Article 16 apply.
13.7 The down payment does not limit any mandatory legal rights of the customer.
Article 14 - Payment
14.1 Payment takes place via a payment method offered by CUPMOVE.
14.2 The customer is responsible for timely and full payment.
14.3 If an amount due is not paid on time, CUPMOVE will act with regard to any payment reminders, statutory interest and extrajudicial collection costs in accordance with the applicable legal rules.
Article 15 - Moving and terminating appointments
15.1 CUPMOVE specifically reserves treatment time for the customer for each appointment.
15.2 Within CUPMOVE's regular booking policy, the basic principle is that a confirmed appointment is rescheduled instead of canceled.
15.3 An appointment can be rescheduled free of charge up to 48 hours before the agreed start time.
15.4 The request for rescheduling must be received by CUPMOVE no later than 48 hours before the agreed starting time.
15.5 In the event of a timely relocation, the deposit already paid remains linked to the appointment and will be deducted from the treatment on the new date.
15.6 A request to move within 48 hours before the agreed starting time is considered a late move.
15.7 In the event of a late rescheduling, CUPMOVE is not obliged to reschedule the original appointment free of charge or to transfer the deposit already paid to a new appointment.
15.8 If CUPMOVE agrees to a late transfer out of goodwill, any additional conditions will be communicated to the customer in advance.
15.9 Within CUPMOVE's regular booking policy, confirmed appointments will not be canceled, but will be rescheduled in accordance with this article. If the customer nevertheless terminates the agreement, the applicable legal rules apply. To the extent permitted by law, CUPMOVE may require reasonable compensation for work already performed, time reserved and reasonable loss of income.
15.10 When determining any compensation, the relevant circumstances will be taken into account, including costs or income that CUPMOVE has been able to save or still obtain due to the cancellation of the appointment.
15.11 If the customer does not show up for the appointment without rescheduling in time, this is a no-show as referred to in Article 16.
15.12 This article does not limit any mandatory right of withdrawal, cancellation, refund or other legal right of the consumer.
Article 16 - No show
16.1 A no-show occurs when the customer does not appear on the agreed date and time without timely relocation.
16.2 In the event of a no-show, the 30% deposit already paid will not be refunded, insofar as this is reasonable and legally permitted given the circumstances.
16.3 In the event of a no-show, the deposit will not be transferred to a new appointment.
16.4 If the customer wishes to book a treatment again after a no-show, this will concern a new booking for which a further deposit may be requested.
16.5 CUPMOVE will not automatically charge the remaining 70% of the treatment price in the event of a no-show on the basis of this article.
16.6 If mandatory legislation gives the right to reimbursement in a specific case, that legal regulation takes precedence.
Article 17 - Arriving late
17.1 The customer must be present on time for her appointment.
17.2 If the customer arrives late, the treatment time can be shortened to prevent subsequent appointments from running late.
17.3 The agreed treatment price may remain payable in the event of a shortening of the treatment caused by the customer, insofar as this is reasonable.
17.4 If, due to the customer's late arrival, insufficient time remains to carry out the treatment safely or responsibly, CUPMOVE may decide not to carry out the treatment.
17.5 If CUPMOVE itself is significantly delayed, a suitable solution will be sought in consultation with the customer.
Article 18 - Cancellation or rescheduling by CUPMOVE
18.1 CUPMOVE can cancel or move an appointment if execution is not reasonably possible, for example due to illness, force majeure or other unforeseen circumstances.
18.2 The customer will be informed of this as soon as possible.
18.3 Where possible, an alternative appointment will be offered.
18.4 If no replacement appointment is agreed, the amount already paid for the treatment not carried out will be refunded.
18.5 This clause does not limit the customer's statutory rights.
Article 19 - Treatment packages
19.1 CUPMOVE can offer packages where multiple treatments are purchased in advance.
19.2 Unless expressly stated otherwise at the time of purchase, the following usage periods apply: 3 treatments: 3 months; 5 treatments: 6 months; 10 treatments: 12 months.
19.3 The period of use starts on the date indicated at the time of purchase.
19.4 The customer is responsible for scheduling the treatments in a timely manner within the period of use.
19.5 A package is personal and non-transferable, unless CUPMOVE allows otherwise in advance.
19.6 Purchasing a package does not guarantee availability on specific days or times.
19.7 If CUPMOVE has structurally insufficient availability during a relevant period, as a result of which the customer cannot reasonably use its package within the agreed period, an appropriate solution will be offered, for example an extension of the period of use.
19.8 A package will not be paid out in cash, unless the customer is entitled to a refund by law.
19.9 Any specific package prices, benefits or discounts will be clearly stated before purchase.
Article 20 - Agreements from a package
20.1 A travel period of at least 48 hours also applies to a scheduled treatment from a package.
20.2 If you move on time, the treatment will remain available within the remaining period of use of the package.
20.3 A request for rescheduling within 48 hours before the appointment counts as a late relocation.
20.4 If the customer does not show up without moving in time, the treatment in question can be registered as used, provided that this consequence has been clearly communicated to the customer before purchasing the package and its application is reasonable in the circumstances.
20.5 Mandatory statutory rights of the consumer remain applicable.
Article 21 - Gift vouchers
21.1 CUPMOVE can offer gift vouchers.
21.2 The value, period of validity and any special conditions of use are clearly stated upon purchase.
21.3 A gift voucher can be used for the treatments for which it was issued.
21.4 A gift voucher will not be paid out in cash, unless the customer is entitled to do so by law.
21.5 The rescheduling period of 48 hours also applies to an appointment booked with a gift voucher.
21.6 In the event of a no-show or late relocation, the conditions communicated to the customer before finalizing the appointment apply.
21.7 Discount codes do not apply to the purchase of a gift voucher, unless CUPMOVE expressly indicates otherwise.
Article 22 - Discounts and promotions
22.1 Discount codes and promotions are only valid during the indicated period and under the conditions stated.
22.2 Discounts cannot be applied retrospectively to bookings or purchases that have already been completed.
22.3 Discounts and promotions cannot be combined, unless CUPMOVE expressly indicates otherwise.
22.4 A discount code cannot be exchanged for cash.
22.5 CUPMOVE may limit a discount code to certain treatments, customers, bookings or periods.
Article 23 - Results
23.1 Every body responds differently to treatment.
23.2 CUPMOVE does not guarantee a specific result, number of treatments required or duration of a result.
23.3 Photos, videos, examples and experiences of other customers are for illustrative purposes only and are not a guarantee of an individual customer's result.
23.4 The absence of a result desired or expected by the customer does not in itself give any right to a refund.
Article 24 - Photos and videos
24.1 If CUPMOVE wishes to use recognizable photos or videos of a customer for social media, the website, advertisements or other marketing purposes, separate permission will be requested where this is required by law.
24.2 Consent for marketing purposes is voluntary and independent of the treatment.
24.3 Refusing consent has no consequences for the treatment.
24.4 A consent granted may be withdrawn for future use to the extent provided by applicable privacy legislation.
Article 25 - Personal property
25.1 The customer remains responsible for personal belongings that she brings to the treatment room.
25.2 CUPMOVE is not liable for loss, theft or damage to personal property insofar as this damage cannot be attributed to CUPMOVE.
Article 26 - Behavior, hygiene and safety
26.1 CUPMOVE strives for a safe, respectful, professional and hygienic treatment environment.
26.2 The customer must follow reasonable instructions regarding safety and hygiene.
26.3 Transgressive, intimidating, aggressive, sexually inappropriate or otherwise unsafe behavior is not accepted.
26.4 CUPMOVE may immediately terminate the treatment in the event of such behavior.
26.5 CUPMOVE may refuse future bookings if there are reasonable grounds for doing so, given previous behavior.
Article 27 - Refusal or termination of treatment
27.1 CUPMOVE may refuse, adjust, postpone or terminate a treatment when:
- a. the treatment is not considered safe or responsible;
- b. relevant health information is missing;
- c. there is or may be a contraindication;
- d. the customer appears under the influence of alcohol or drugs;
- e. safety or hygiene cannot be sufficiently guaranteed;
- f. there is transgressive, intimidating or unsafe behavior;
- g. continuation cannot reasonably be expected of CUPMOVE for another compelling reason.
27.2 Where possible, the customer will be explained why the treatment cannot be carried out or continued.
27.3 The financial settlement depends on the reason for refusal or termination, any part of the treatment that has already been carried out and the applicable legal rules.
Article 28 - Liability
28.1 CUPMOVE is responsible for careful implementation of the agreed treatment.
28.2 The customer is responsible for providing correct and complete information that he knows or can reasonably understand is relevant to safe treatment.
28.3 If damage arises partly because the customer has provided incorrect or incomplete information or has concealed it, this can be taken into account when assessing liability.
28.4 The same applies if damage arises partly because clearly provided and reasonable safety or aftercare instructions are not followed.
28.5 The mere absence of an expected treatment result does not mean that CUPMOVE has failed to perform the agreement.
28.6 CUPMOVE does not exclude liability for damage for which liability cannot be excluded or limited under mandatory Dutch law.
Article 29 - No medical care
29.1 CUPMOVE does not provide medical care and does not make medical diagnoses.
29.2 Information that CUPMOVE provides verbally, in writing, via the website, social media or other channels is general information about the treatments offered and does not constitute individual medical advice.
29.3 In case of medical complaints, unexplained pain, sudden changes or doubts about health, the customer should consult a doctor or other qualified healthcare professional.
Article 30 - Privacy and personal data
30.1 CUPMOVE processes personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable privacy legislation.
30.2 Personal data will only be processed if there is a valid basis for this and to the extent that it is necessary for the relevant purpose.
30.3 Information about the physical or mental health of a customer can qualify as special personal data. Additional legal conditions apply to the processing thereof.
30.4 CUPMOVE only processes health data if there is both a valid basis for this and an applicable exception for the processing of special personal data.
30.5 CUPMOVE takes appropriate technical and organizational measures to protect personal data.
30.6 Personal data will not be kept for longer than is necessary for the purpose for which it is processed or as required by law.
30.7 The separate CUPMOVE privacy statement further explains which personal data are processed, for what purposes, on what basis, which retention periods are used, with which parties data may be shared and what privacy rights the customer has.
Article 31 - Online bookings and legal cooling-off period
31.1 When a consumer concludes an agreement with CUPMOVE online or in another way, the legal rules for distance contracts apply to the extent that the law provides.
31.2 Insofar as no legal exception applies, the consumer has the right to withdraw from the agreement without giving any reason within a period of 14 days after the conclusion of the agreement.
31.3 Before concluding the agreement, CUPMOVE provides the legally required information about the right of withdrawal and how it can be exercised.
31.4 If the customer wants treatment to take place during the statutory cooling-off period, CUPMOVE may ask the customer to expressly request that the service be started before the cooling-off period expires.
31.5 If the service is fully performed during the cooling-off period, the right of withdrawal will only lapse if the legal conditions for this are met.
31.6 If the customer validly withdraws during the cooling-off period after the execution has already started at the customer's express request, the customer may owe a proportionate amount for the part already carried out if the legal conditions for this have been met.
31.7 The statutory right of withdrawal is separate from the regular 48-hour policy for rescheduling reserved appointments.
31.8 If a mandatory legal right of withdrawal, cancellation or refund applies, that right takes precedence over the provisions on relocation, down payments and no-show.
31.9 CUPMOVE facilitates the legally required option for online agreements to exercise the right of withdrawal electronically, insofar as this obligation applies to the relevant agreement and booking environment.
Article 32 - Complaints
32.1 A customer who is not satisfied with a treatment or service is requested to inform CUPMOVE as soon as possible.
32.2 Complaints can be submitted via info@cupmove.com.
32.3 The customer is requested to clearly describe the complaint and provide sufficient information to identify the appointment in question.
32.4 CUPMOVE will carefully investigate the complaint and respond within a reasonable period.
32.5 Submitting a complaint does not limit the customer's legal rights.
Article 33 - Force majeure
33.1 If CUPMOVE is temporarily unable to carry out a treatment due to circumstances beyond its reasonable control, the appointment can be rescheduled.
33.2 Depending on the circumstances, this may include acute illness, calamities, serious technical disruptions, government measures or other unforeseen circumstances.
33.3 If performance becomes permanently impossible, any payment and reimbursement obligations will be handled in accordance with the applicable legal rules.
Article 34 - Changes to the general terms and conditions
34.1 CUPMOVE may change these general terms and conditions for future agreements.
34.2 In principle, the version that applied at the time the agreement was concluded remains applicable to an agreement that has already been concluded.
34.3 Changes do not limit any mandatory legal rights of the customer.
34.4 The current version of the general terms and conditions will be made available through CUPMOVE's usual channels.
Article 35 - Applicable law and disputes
35.1 Dutch law applies to agreements between CUPMOVE and the customer.
35.2 Disputes can be submitted to the competent court according to the law.
35.3 This article does not limit any mandatory rights that a consumer has under applicable law.
Article 36 - Final provisions
36.1 Before concluding the agreement, the customer is given the opportunity to consult these general terms and conditions and, in the case of an online agreement, to save them electronically.
36.2 If any provision of these terms and conditions proves to be invalid or unenforceable, the other provisions will continue to apply.
36.3 If a provision appears to be contrary to mandatory law, the applicable legal regulation will prevail.
36.4 These general terms and conditions were established in September 2026.
